2. The petitioner is apprehending his arrest in Civillines P.S. Case No. 163 of 2020 registered under Sections 323, 420, 467, 468, 406, 464, 463, 465, 466, 469, 470, 471, 474, 504, 506 and 120(B) of the Indian Penal Code.
3. The complainant claims herself to be wife of the petitioner Pramod Kumar Mishra. According to allegation , she was co-owner of the property in question which was leased to accused No. 4 Praveen Kumar. The informant was ousted from
Patna High Court CR. MISC. No.58795 of 2024(5) dt.08-09-2025 2/3 her house. It has further been alleged that the accused Nos. 1, 2 & 3 registered the lease deed on 22-11-2019 in favour of accused No. 4 fraudulently. She alleged that she was impersonated and her photographs and thumb impression were affixed on the lease deed.

It has been submitted on behalf of the petitioner that the complainant is not wife of the petitioner and misrepresenting herself as wife of the petitioner, she lodged the present false and frivolous complaint against the petitioner including the lease holder Praveen Kumar. Learned counsel has further submitted that the lease deed was executed on 22-10-2011 whereas the present case was lodged after nine years in the year, 2020. The co-accused Praveen Kumar has been granted anticipatory bail by a coordinate bench of this court by order dated 16-06-2025 passed in Cr. Misc. No. 62411 of 2024. The petitioner has filed Title Suit in respect of the land in question in the year, 2018. Thereafter, the present complaint has been filed.
5. Notice was sent to the complainant but she did not appear.
6. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks, be

No.58795 of 2024(5) dt.08-09-2025 3/3 released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Civillines P.S. Case No. 163 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
