JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.

The stolen mobile is said to have been recovered from conscious possession of the petitioner but according to prosecution case itself, the ornaments and other articles had also been stolen and except the aforesaid mobile, nothing is said to have been recovered from possession of the petitioner, who is in jail custody since 29.08.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.47122 of 2016 (2) dt.27-10-2016 2/2 two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Sonepur, Saran in connection with Chapra Rail P.S. Case No. 49 of 2016.
