JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-08-2015 Heard learned counsels for the petitioners and the State. The petitioner no.1 being first wife of the husband of the victim and petitioner nos. 2 to 4 being father and brothers of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
The prosecution case is that the sister of the informant Sahodri Devi was married with Bhushan Chauhan on 12.5.2014. Bhushan Chouhan performed second marriage with the sister of the informant as Bhushan was earlier married with petitioner no. 1 Basanti Devi but since there was no issue, hence he performed
Patna High Court Cr.Misc. No.33375 of 2015 (2) dt.12-08-2015 2/2 second marriage. On recovery of mutilated dead body of the victim the FIR was lodged, raising suspicion against the entire inlaws family. It is submitted by the learned counsel for the petitioners that only on suspicion the accusation has been levelled. It is further submitted that mother of the husband of the victim Shiv Ratiya Devi has been granted bail vide Cr. Misc. No. 45079 of 2014.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda at Biharsharif in connection with Bihar P.S. Case No.347 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
