Petitioner, who is in custody, seeks bail in connection with Rajpur P.S. Case No. 275 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 385 and 120B of the Indian Penal Code.
Informant has alleged that when he was holding a meeting in the office of Jan Adhikar Party, FIR named accused entered and started indiscriminate firing on the informant as well as workers assembled there.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case on account of political rivalry. There is specific allegation against Manoj Singh and Santosh
Patna High Court Cr.Misc. No.67557 of 2018(2) dt.27-11-2018 2/2 Singh of firing on the informant. Allegation against petitioner is causing fire arms injury on Ram Pravesh Singh. Injury report has been enclosed as Annexure-2, it is simple in nature. It has been further submitted that similarly placed co-accused Manoj Singh has already been granted bail by another co-ordinate Bench of this Court in Cr. Misc. No. 62584 of 2018 vide order dated 02.11.2018. He has no criminal antecedent and he is in custody since 18.08.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Buxar in connection with Rajpur P.S. Case No. 275 of 2017.
