The petitioner is in custody in connection with Special Case No. 78 of 2018 (DRI/LZU/PRU/718(ii)/ENQ-14 of 2018) for the offence under Sections 20(b)/23/25/29 of the NDPS Act. In the instant case there is recovery of 468.6 Kg of Ganja.
Learned counsel for the petitioner submits that the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 16.05.2019. Considering the fact that the petitioner has got no criminal antecedent and he is in custody since 16.05.2019, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees one lakh) with two sureties of the like amount each to the satisfaction of
Patna High Court CR. MISC. No.51590 of 2019(2) dt.23-08-2019 2/2 Additional Sessions Judge-IV -cum- Special Judge, Patna in connection with Special Case No. 78 of 2018 (DRI/LZU/PRU/718(ii)/ENQ-14 of 2018) subject to the condition that the petitioner shall deposit Rs.2,00,000/- (Two lakh) cash in the court below and the same shall be abide by the final outcome in the trial i.e. if the petitioner is acquitted the amount of Rs.2,00,000/- shall be refunded in favour of the petitioner, otherwise it shall be forfeited with the further condition that the petitioner shall appear on each and every date fixed by the court below and if the petitioner fails to appear in the court below on two consecutive dates without any cogent reason, the court below shall be at liberty to cancel the bail bonds of the petitioner.
