The petitioner has prayed for regular bail in a case registered for the offence punishable under section 384, 386/34 of the IPC and Section 17 of CLA Act.

As per allegation in the FIR, informant was S.I. and he received information about pasting of pamphlet which bears threatening and ransom demand, if they want to continue the construction of road work. It is further alleged that on 5.5.2014, prior to this incident, tractor of construction company were torched for which Wazirganj P.S. Case No. 188 of 2014 were registered.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.58881 of 2023(2) dt.01-09-2023 2/2 that petitioner has been falsely implicated in this case. There is no eye witness of the alleged occurrence. Nothing has been recovered from his conscious possession. During investigation, no consistent material has come against the petitioner to show his complicity in the present case. Petitioner is languishing in judicial custody since 17.05.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Gaya in connection with Wazirganj P.S. Case No.220 of 2014.
