JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Bidupur P.S. Case No. 149 of 2018 dated 25.05.2018 instituted for the offences under Sections 364/34 of the Indian Penal Code.

The petitioner and others are alleged to have taken away the husband of the informant to Tamilnadu for making him earn his living. Thereafter, there is no trace of the husband of the informant. It has been alleged that whenever the informant visited the petitioner and others to enquire about her husband, no definite answer was given by the petitioner.

No.69127 of 2018(2) dt.19-12-2018 2/3 submitted that an absolutely false case has been instituted by the informant who is working as maid servant in the house of Umashankar Singh and Chalitar Singh, who are having civil dispute with the petitioner. In support of the aforesaid fact, the petitioner has annexed the memo of Title Suit No. 861 of 2014 which is pending adjudication before the Courts of law. It has further been submitted that local persons of the village have also intimated to the S.D.O., Hajipur at Vaishali stating that the husband of the informant is hiding somewhere in and around the village only for the purposes of falsely implicating the petitioner and others. The petitioner is stated to be seventy years of age and does not have any criminal antecedents.

Regard being had to the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in
