The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302/120B/34 of the Indian Penal Code 25(1-B)a/27 of the Arms Act. It is alleged that all the accused persons including petitioner came variously armed and assaulted Lalita Singh when Hari Narayan Singh caused fire arm injury on the abdomen and back of Lalita Singh whereas this petitioner alleged to have caused fire arm injury on his head, as a result, Lalita Singh died at the spot.
It is submitted by learned counsel for the petitioner that there is counter version of the occurrence when two persons from the petitioner's side had been kidnapped earlier.
Patna High Court Cr.Misc. No.35538 of 2015 (2) dt.04-09-2015 2/2 Considering the specific accusation of causing fire arm injury on the head of the informant is against the petitioner, this Court is not inclined to grant anticipatory bail to him. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bhagwanpur P.S. Case No.171 of 2014, pending before the learned SDJM, Bhabhua. With the above observation, this application is, accordingly, disposed off.
