JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-12-2018 The petitioner seeks bail in connection with Gopalpur P.S.Case No. 195 of 2017 registered under Sections 379, 401, 411, 413, 414, 419, 420, 467, 468 and 471/34 of the Indian penal Code.

Earlier prayer of bail of the petitioner was rejected vide order dated 20.03.2018 passed in Cr. Misc. No. 15187 of 2018 with direction to conclude the trial within a period of six months.

Allegation is of recovery of stolen motorcycle from the possession of the petitioner and he has two criminal antecedents also.

Submission of learned counsel for the petitioner is that period of six months has already expired and he is in custody

Having heard both sides and considering the observation as also the petitioner remained in custody for more than a year, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-IX, Patna in connection with Gopalpur P.S. Case No. 195 of 2017 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and also petitioner will co-operate in the disposal of trial and make himself available as and when required by the court and in the event of failure to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.
