1. Heard learned counsel for the petitioner, learned counsel for the opposite party no.2 and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Section 498(A) of the Indian Penal Code.

3. The learned counsel for the opposite party no.2, at the outset, submits that the dispute is matrimonial and petitioner is the husband of the opposite party no.2 and he has instructions on behalf of opposite party no.2 to make submission that opposite party no.2 shall have no objection in the event, if

Patna High Court CR. MISC. No.53513 of 2023(5) dt.15-02-2024 2/2 anticipatory bail application is allowed as the dispute in between the petitioner and the opposite party no.2 stands resolved and they are leading a peaceful conjugal life.

4. The learned counsel appearing on behalf of the petitioner concurs.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of Moss Anjalinag, the learned Judicial Magistrate, 1st Class, Bikramganj, Rohtas in connection with Complaint Case No.744 of 2022, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

6. The application stands allowed.
