JUSTICE ALOK KUMAR SINHA ORAL ORDER 10-10-2025 Heard learned counsel for the petitioner, learned counsel appearing on behalf of the respondent-State and learned counsel for the Bihar Staff Selection Commission.

The petitioner has prayed for grant of following relief :- (i) Issuance of writ in the nature of mandamus commanding the respondents for the direction to make appointment/filling up on the vacant post of Panchayat Sewak(Secretary) in the District of Patna to the petitioner being Dalpati and who are being paid stipend in the District of Patna.

(ii) The Respondents be directed to act under the policy decision taken by the.

Patna High Court CWJC No.13932 of 2025(2) dt.10-10-2025 2/3 (iii) The Respondents further be directed to appoint/filling up the petitioners being the stipend paid Dalpatis to the 111 vacant posts of Panchyat Sewak (Nomenclature changed as Panchayat Sachiv) in District of Patna, who having prepared in seniority list of Dalpatis.

Learned counsel for the petitioner submits that for the aforesaid relief claimed in the present writ application, the petitioner is prepared to file a representation before the District Magistrate, Patna and prays for to decide the representation within a fixed time frame after giving an opportunity of hearing to the petitioner.

4. To the aforesaid submissions made by learned counsel for the petitioner, learned counsel appearing for respondent-State as well as learned counsel for Bihar Staff Selection Commission do not have any objection.

5. Considering the limited nature of prayer being made by learned counsel for the petitioner, the present writ application is disposed of granting liberty to the petitioner to file a detail representation along with the supporting documents before the District Magistrate, Patna within one month from the date of passing of this order. If such a representation is filed within time stipulated, the District Magistrate, Patna shall dispose of the same within a further period of six months after giving an opportunity of hearing to the petitioner.

6. Needless to emphasise that the final order which had been passed by the District Magistrate, Patna should be a reasoned and speaking order.

7. With the aforesaid observation and direction, the present writ application stands disposed of.
