JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 22-07-2015 I have heard learned counsel for the petitioner and the Bank of Baroda.
Sole grievance of the petitioner is that though he had filed an appeal against the order dated 20th January, 2011 passed by the Deputy General Manager-cum-Disciplinary Authority on 02.03.2011 which was duly received by the office of the General Manager-cum-Appellate Authority, same has not been disposed of as yet. He claims to have sought information under the Right to Information Act regarding the appeal but he was astonished to find from the information given that the memorandum of appeal is not available on record. Aforesaid fact has compelled the petitioner to
Patna High Court CWJC No.10399 of 2015 dt.22-07-2015 2/2 approach this Court by filing the present writ application. Learned counsel appearing for the Bank submits that the records are not available in the office now whether the memorandum of appeal was received by the competent authority or not. However, from Annexure-5, it appears that there is a signature of receiving along with a seal of the Zonal Office of the Bank of Baroda, Patna. Confronted with such a situation he fairly submits that in place of perusing the issue as to whether the file is available or not, the appeal would be considered and disposed of by the appellate authority within a period of two weeks on its own merit and in accordance with law. On such fair stand has been taken by the Bank, this Court is inclined to dispose of this writ application with a direction to the respondent no.1 to dispose of the appeal of the petitioner considering Annexure-5 as the memorandum of appeal within a reasonable period preferably within three months from the date of receipt/production of a copy of this order.
It is made clear that this Court has not formed any opinion regarding the merit of the case of the petitioner. (Dr. Ravi Ranjan, J) N.H./- U
