Petitioner is in custody since 16.09.2016 in connection with Wazirganj P.S. Case No. 323 of 2016 registered under Sections 366(A) of the Indian Penal Code.

Accusation is of abduction of daughter of informant for the purpose of marriage.

Learned counsel for the petitioner has submitted that there was love affair between the petitioner and the daughter of the informant. Further, as per statement under Section 164 Cr.P.C., the victim has specifically stated that she had gone with petitioner out of her sweet will and the petitioner has never forced her to got with him or marry him. Moreover, petitioner is in custody for the last three and half months.

Learned A.P.P. has opposed the prayer for bail. 6.

Considering the facts and circumstances of the case and

No.746 of 2017 (2) dt.12-01-2017 nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1st, Gaya, in connection with Wazirganj P.S. Case No. 323 of 2016.
