JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kuchaikote P.S. Case No. 205/2018 registered for the offences punishable under Sections 393 and 491 of the Indian Penal Code and Sections 25(1-b), A, 26/35 of the Arms Act. The informant got secret information that some criminals have assembled to commit crime and after that he went there and arrested some persons from whose possession fire-arms and other articles were recovered. However, apprehended persons disclosed the name of the petitioner. Paragraph 3 of the petition goes to show that the petitioner does not have any criminal antecedents and,

Patna High Court Cr.Misc. No.68641 of 2018(2) dt.13-12-2018 2/2 admittedly, neither the petitioner was caught at the spot nor anything was recovered from his conscious possession. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-VII, Gopalganj in Kuchaikote P.S. Case No. 205/2018 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
