JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-08-2023 At the outset, learned counsel for the petitioners seeks permission to make correction in the prayer portion of the main petition and prays that let satisfaction of court below be read as 'learned Additional Chief Judicial Magistrate' instead of 'learned Judicial Magistrate'.

3. Heard learned counsel for the petitioners and the State.

4. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 148, 323, 326, 379, 448, 504 and 506 of the Indian Penal Code.

5. As per prosecution case, these petitioners assaulted the informant and her husband with knife and snatched Rs. 3,000/- from pocket of the husband of the informant.

6. Learned counsel for the petitioners submits that both the parties are neighbours and due to petty dispute scuffle took place between them. Doctor has found simple injury and F.I.R. has been lodged after inordinate delay of 3 days. It is further submitted that rest of the allegations are super addition in order to make the case grave.

Considering the nature of accusation and simple injury, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sheosagar P. S. Case No. 458 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
