ANJANA MISHRA ORAL ORDER 14-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Kahalgaon P.S. Case No.213 of 2015 for allegedly having committed the offence under Section 376/34 of the Indian Penal Code, Section 4 of the POSCO Act and Section 3(1)(x)(xi) of the S.C./S.T. Act.

Learned counsel for the petitioner submits that the allegation, if any, is against one Bihari Tanti and not this petitioner. Learned counsel further submits that only allegation levelled against this petitioner is that he had given a lift to Bihari Tanti on his motorcycle and as such, no case is made out against him under the relevant Section of the Cr.P.C. and of

Patna High Court Cr.Misc. No.32116 of 2015 (2) dt.14-08-2015 2/2 Section 4 of the POCSO Act.

Considering the aforementioned facts and circumstances and that the petitioner has clean past, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgaon P.S. Case No.213 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
