In the present case, the petitioner is claiming his ACP as per the ACP Rules, 2003, having been stated that he has been denied the due benefit which he is entitled to get and submitted that his case is identical to the L.P.A. No. 239 of 2015 (The State of Bihar & Ors. Vs. Surya Nath Pathak) arising out of C.W.J.C. No. 19876 of 2011, the aforesaid order squarely covers the issue involved in the present case. In such view of the matter, the concerned Authority is directed to examine the case of the petitioner and if it is found that facts, law and prayer of the present case is squarely covered by the aforesaid case, the same benefit should also be extended to the petitioner.
Patna High Court CWJC No.12341 of 2015 dt.30-11-2018 2/2 Whole process should be completed within a period of six months from the date of receipt/production of a copy of this order.
With the aforesaid observations and directions, this writ petition is disposed of.
