JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-11-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 17.05.2016 passed in Cr. Misc. No. 14233 of 2016, on the ground of observation made in order dated 17.05.2016 whereby the petitioner was given liberty to renew his prayer of bail after remaining nine months in custody from the date of his remand and the petitioner is in custody since 09.02.2016 and now he has completed the custody of nine months and as such he deserves sympathetic consideration to which learned APP opposes.

In the facts and circumstances stated above and in view of the earlier observation, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.49471 of 2016 (2) dt.23-11-2016 satisfaction of Sri Randhir Kumar, J. M. Ist Class, Danapur in connection with Maner P.S. Case No. 399 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
