Petitioner seeks bail in Bodh Gaya P.S. Case No. 119/18 registered for the offence under Sections 363, 365, 302, 201, 120(B)/34 of the I.P.C.
Allegation as per the F.I.R. is that the petitioner is the wife of co-accused Upendra Chaudhary who happens to be the brother of F.I.R.named accused Jitu Chaudhary from whose house the husband (since deceased) of the informant had gone to bring chiraiyan and thereafter his mobile was switched off. The petitioner is not named in the F.I.R. but later on her name transpires on the basis of confessional statement of co-accused Jitu Chaudhary.
Submission on behalf of the learned counsel for the
Patna High Court Cr.Misc. No.64344 of 2018 (2) dt.26-10-2018 2/2 petitioner is that except confessional statement of co-accused there is nothing against her and she is in custody since 30.06.2018 having no criminal antecedent and co-accused Upendra Chaudhary who has confessed the name of the petitioner has already been granted anticipatory bail by coordinate Bench of this Court vide order dated 27.09.2018 passed in Cr.Misc.No.51572/18. Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances of the case, stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- with two sureties of the like amount each to the satisfaction of C.J.M.,Gaya, in Bodh Gaya P.S. Case No.119/18 subject to the condition that bailers must be of local having sufficient properties within the jurisdiction of the court concerned (Vinod Kumar Sinha, J) AnilKrSinha/- U
