The petitioner seeks bail in Kursela P.S. case No. 74/2018 registered u/s 341, 342, 323, 307, 302, 34 of the IPC and u/s 27 of Arms Act.
The informant made specific allegation that petitioner fired causing fire arm injury on the shoulder of the deceased. The learned counsel for the petitioner submits that prayer of petitioner for bail was earlier rejected by this court vide order dated 19.06.2020 passed in Cr. Misc. No. 20041/2020. The trial court was directed to conclude the trial within four months from the date of receipt of the order. On query, the petitioner could not inform the court about the stage of trial. Taking into consideration the facts aforesaid and the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
The petitioner may move before the trial court for bail so that the trial court must explain the reason for not concluding the trial within the stipulated period, as directed by this court, and thereafter may again move this court.
