Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 25(1-b)a/26/35 of the Arms Act, registered in connection with Lakhisarai P.S.Case No. 307 of 2022.

As per allegation, one country-made pistol and two cartridges were recovered from a pick-up van. The driver of the vehicle fled away.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.53983 of 2022(2) dt.31-01-2023 2/2 that he is the owner of the vehicle. He is an old person of 80 years of age having no criminal antecedent. He had assigned the vehicle to his driver and was unaware of the fact as to what the driver had kept in his vehicle.

Considering the above facts and circumstances as well as the clean antecedent, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Lakhisarai in connection with Lakhisarai P.S.Case No. 307 of 2022 (G.R.No. 594 of 2022), subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
