JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2016 Heard learned counsel for the petitioners, learned Additional Public Prosecutor for the State and learned counsel, appearing for the informant.
Petitioners seek bail in a case registered under Sections-406, 420/34 of the Indian Penal Code. Petitioners are in jail custody since 21-07-2016 on the accusation that they took rice and paddy from the informant and others worth Rs. 48,00,000/- (forty eight lacs) but they did not make payment to the informant and others.
Submission on behalf of petitioners is that except the oral statement of witnesses, there is not a single chit of paper to show the above-said transaction and moreover, petitioners are in
Patna High Court Cr.Misc. No.40418 of 2016 (2) dt.29-09-2016 2/2 jail custody since long.
On the other hand, learned counsel appearing for informant submits that all the witnesses have supported the prosecution story and except the informant, rest persons have some documents to prove the above-said transaction. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Konch P.S. Case No. 69 of 2009 to the satisfaction of learned Additional Chief Judicial Magistrate-III, Gaya.
