JUSTICE BIRENDRA KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are languishing in custody for offences punishable under Section 47(a) of the Bihar Excise (Amendment) Act, 2016 and Section 147 of the Railway Act. Foreign liquor was allegedly recovered from the railway station from the possession of the petitioners and others. Submission of the petitioner is that recovery was made on 18.08.2016 and possession of foreign liquor on that day was not an offence. Moreover, some other co-accused have already been allowed bail by a coordinate Bench in Cr. Misc. No. 50372 of 2016 on 22.11.2016.
