This is a petition for grant of regular bail for offence under Sections 147, 148, 149, 341, 323, 325, 326, 353, 379, 307, 504, 506, 272 and 34 of the Indian Penal Code and 47A of the Excise Act.
It appears that co-accused, Manjhala Basuki, had already been allowed bail by the lower Court. The allegation against Manjhala Basuki was of commission of assault causing injury at the head of the informant and, further, allegation is that he snatched service revolver of the informant whereas allegation against the petitioner is that country made liquor was found in the house of this petitioner in the quantity of 30 liters. In my view allegation against the petitioner is of better footing to that of Manjhala Basuki.
Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Pirpainti P.S. Case No. 77 of 2012 to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, or successor Court.
