JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 379 of the Indian Penal Code and later on Section 411 of the Indian Penal Code is added.
Allegation is theft of motorcycle of informant from the Civil Court premises.
It has been submitted on behalf of petitioner that he is in custody since 30.9.2016. He has got no criminal antecedent. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner is not named in the F.I.R. Petitioner is said to have purchased one theft motorcycle. He had no knowledge at the time of purchase that the motorcycle in question was a theft one. On behalf of the State, it is submitted that petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like
Patna High Court Cr.Misc. No.52007 of 2016 (3) dt.08-12-2016 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Araria P.S. Case no. 598 of 2016.
