The petitioners seek bail in anticipation of their arrest in connection with Patahi P.S. Case No. 107 of 2020, dated 23.06.2020, instituted for the offences under Sections 147, 341, 323, 324, 307 and 504 of the Indian Penal Code.

Patna High Court CR. MISC. No.9908 of 2021(2) dt.20-12-2021 2/3 It has been alleged in the F.I.R. that the petitioners and four others assaulted the informant and the members of his family.

The learned counsel for the petitioners has submitted that there is no injury report on record and there is a counter version of the occurrence as well, which has been lodged by the brother of petitioner No. 1. It has further been submitted that the petitioners are agnates of the informant and because of some dispute, an occurrence had taken place in which both the sides had participated. None of the parties have received any injury, much less life threatening injury.

Regard being had to the facts afore-stated, the petitioners, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Patahi P.S. Case No. 107 of

Patna High Court CR. MISC. No.9908 of 2021(2) dt.20-12-2021 3/3 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
