2. The petitioner seeks bail in connection with Patepur P.S. Case No. 253 of 2023 instituted for the offences punishable under Section 392 of the Indian Penal Code.

3. As per the prosecution case, F.I.R. has been lodged against three unknown accused persons including the present petitioner against whom there is allegation that petitioner along with the others have committed dacoity in the shop of the informant and assaulted the informant.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that he has clean antecedent. He further submits that the

He further submits that nothing incriminating substance has been recovered from the possession of the petitioner.

5. Learned APP for the State opposes the prayer for bail of the petitioner

6. From perusal of the F.I.R., impugned order and case diary, it appears that the allegation levelled against the petitioner is in serious in nature. Moreover, the investigation is still going on. Therefore, I am not inclined to grant bail to the petitioner.

7. Accordingly, the anticipatory bail of the petitioner is hereby rejected.
