JUSTICE SATYAVRAT VERMA ORAL ORDER 04-02-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Sirdala P.S. Case No. 160 of 2021 instituted for the offences under Sections 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 24.08.2021 and charge-sheet has been submitted in the case.

Learned counsel for the petitioner submits that allegation is of recovery of 105 litres of mahua and 1455 litres of sweet mahua, out of which 50 litres of mahua and 1400 litres of sweet mahua solution was recovered from an open field, which does not belong to the petitioner and petitioner is alleged

Learned counsel for the petitioner submits that the petitioner was not arrested from the place of occurrence and based on secret information came to be falsely implicated in the present case.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 24.08.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise, Nawada in connection with Sirdala P.S. Case No. 160 of 2021 with a condition that one of the bailor shall be the father of the petitioner (Dular Rajbanshi).
