JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Shahpur P.S. Case No. 172 of 2014, disclosing offences under Sections 386,307, 504/34 of the Indian Penal Code. It is submitted on behalf of the petitioner, referring to the First Information Report that he has no criminal antecedent and he has been implicated only because of the criminal antecedent and conduct of his brother Lotha. I find force in the submission made on behalf of the petitioner, on the basis of the contents made in the First Information Report.
In view of the submissions as above, this application is accordingly, allowed. Let the petitioner, above named, in the
Patna High Court Cr.Misc. No.32601 of 2015 (2) dt.14-08-2015 event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Anil Kumar Thakur, learned Judicial Magistrate, Ist Class, Danapur in Shahpur P.S. Case No. 172 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall liable to be cancelled.
