JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-10-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State. The petitioner seeks bail in connection with Naokothi P.S. Case No. 71 of 2015 registered for the offences punishable under Sections 386, 387/34 of the Indian Penal Code. Petitioner is in jail custody for more than one year and earlier his prayer for bail was rejected by this Court vide order dated 11.02.2016, passed in Criminal Miscellaneous No. 4424 of 2016.
Submission on behalf of the petitioner is that no such occurrence, as alleged in the FIR, did ever take place and as a matter of fact, some quarrel took place between the petitioner and the informant and the informant, with the help of his supporters,
Patna High Court Cr.Misc. No.43872 of 2016 (2) dt.05-10-2016 2/2 caught this petitioner and handed over him to the Police. It is further submitted that the petitioner is in jail custody since 24.06.2015 but uptill now, not a single prosecution witness has been examined.
Considering the aforesaid facts and circumstances as well as submissions of the parties, the petitioner above named is directed to be released on bail on execution of bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Pankaj Pandey, J.M. 1st Class, Begusarai, in connection with Naokothi P.S.
