JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

On getting confidential information regarding assemblage of anti-social elements, police conducted raid and during course thereof, there was cross firing wherein one of the miscreants sustained injury however, police succeeded in apprehending other members of the gang including the petitioner. So far recovery from the possession of petitioner is concerned, as per written report it is evident that one empty country made pistol along with cash appertaining to Rs.160/- was seized and for that petitioner happens to be under custody since 14.05.2016 having no criminal antecedent as per para-3 of the petition.

Accordingly, petitioner Himanshu Kumar is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate,
