JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-12-2018 The petitioner seeks bail in connection with Sessions Trial No. 406 of 2018 arising out of GRP Baktiyarpur P.S.Case No. 26 of 2018 registered under Sections 307 and 353/34 of the Indian penal Code and 25(1-B)a/26 of the Arms Act. Allegation as per the FIR is that the police found two miscreants in suspicion condition near the railway track and one of them tried to fired at the police party but he could not succeed and it is stated that from the possession of the petitioner, one country made pistol was recovered. Apart from that, it appears that petitioner is accused in three more cases. Submission of learned counsel for the petitioner is that petitioner has been falsely implicated in this case, he is in custody for nine months. He submits that though petitioner has

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions JudgeVIII, Patna in connection with S.T.No. 406 of 2018 arising out of GRP Bakhtiyarpur P.S. Case No. 26 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
