Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 307, 353, 120B, 323 of the Indian Penal Code as well as Sections 25(1-b) A, 26, 27, 35 of the Arms Act and Sections 30(A), 38, 41 of the Bihar Prohibition and Excise (Amendment) Act, 2016. Petitioner is permitted to correct the name of the village in the cause title.

Submission is that nothing was recovered from the possession of the petitioner, rather name of the petitioner surfaced in the confessional statement of co-accused before Police while they were in Police custody.

Considering the aforesaid submission, let the

Patna High Court CR. MISC. No.50000 of 2019(2) dt.13-08-2019 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Special Excise Case No.3438 of 2019, arising out of Barh Police Station Case No.163 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
