Petitioner who was wanted of Bachhawara P.S. Case No.39/2016 was apprehended along with Ramchandra Mahto, another history sheeter and during course of search, from the possession of the petitioner one country made loaded pistol along with five live cartridges were seized. From para-3 of the petition it is evident that petitioner happens to be an accused in six other cases including one of arms act.
Learned counsel for the petitioner submits that for the last eight months he happens to be under custody and so, he be released on bail on any kind of rigor of conditions so desired by the court.
The learned Additional Public Prosecutor opposed the prayer.
Considering the criminal antecedent of the petitioner, petitioner is not found entitled for grant of bail at the present whereupon
Patna High Court Cr.Misc. No.49468 of 2016 (3) dt.09-02-2017 prayer for bail is rejected. Learned lower court is directed to expedite the trial and conclude the same within six months for that office is directed to communicate the Superintendent of Police, Begusarai as well as the learned lower court for effective compliance.
