2. The petitioner is the husband of Late Kasturi Devi who died while serving as Aanganwari Sevika on 04.02.2019. The death certificate of the wife of the petitioner has been issued by the competent authority on 24.02.2019 which has been brought on record.

3. It has been submitted on behalf of the petitioner that in the light of the resolution of the Government dated 22.08.2015 issued by the Social Welfare Department of the Government, the next kith and kin of an Aanganwari Sevika/Sahayika who dies while

Patna High Court CWJC No.15165 of 2019 dt.31-07-2019 2/2 remaining in duty is entitled to an ex gratia payment of Rs. 4 lakhs.

4. The petitioner claims to be the nearest relative of the deceased Aanganwari Sevika and therefore seeks direction to the respondent authorities to make available to him the ex gratia payment for the death of his wife.

The petitioner therefore is directed by this Court to make a representation before the District Programme Officer, Gopalganj (respondent no. 4) who shall enquire into the matter, verify and ascertain the entitlement of the petitioner to receive ex gratia payment and if the claim of the petitioner is found to be tenable, shall pass necessary order for such ex gratia payment. The representation shall be filed within a period of four weeks from today and the concerned respondent shall pass order within a period of six weeks of the receipt of such representation.

6. With the aforesaid direction/observation, the writ petition is disposed of.
