Petitioner seeks bail in Ballia P.S. Case No. 143 of 2018 instituted for the offence under Section(s) 8/30(b)(ii)(c), 25/29 of NDPS, Act.

Counsel for the petitioner submits that petitioner was a labourer. He was merely loading the Ganja on the pick up van. He has no concern with the aforesaid Ganja.

In the written report, it is alleged that five persons including the petitioner were found loading the Ganja on pick up van.

It has been further submitted that co-accused, Mithun Kumar @ Tufani Yadav, with similar allegation has already been granted bail by this Court vide order dated 08.10.2018 passed in

Patna High Court Cr.Misc. No.69032 of 2018(2) dt.30-11-2018 2/2 Cr. Misc. No.61363 of 2018.

Petitioner is said to be in custody since 31.05.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge NDPS, Begusarai, in connection with Ballia P.S. Case No. 143 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
