ANJANA MISHRA ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 03.05.2019 in connection with POCSO 11/19 (arising out of Beldaur P.S. Case No.63 of 2019 registered for the offence under Sections 376/34 of the Indian Penal Code and Section 3⁄4 of the POCSO Act, which is pending before the learned Additional Sessions Judge 1st, Khagaria.
Considering the nature of allegations and there being cogent material on record to support that the victim girl is a major and that the case is covered by the POCSO Act, I am not inclined to grant regular bail to the petitioner. It is, accordingly, rejected.
However, the trial of the case be expedited.
