JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,467,468,471,192,196 and 199/34 of the Indian Penal Code and section 7 of the E.C. Act.

Sixty bags of rice were seized when it was suspected that it was being transported from BSFC godown for black marketing. The petitioner was Assistant Godown Manager, Pachrukhi, Siwan from where it was suspected to have been transported.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.33878 of 2015 (2) dt.18-08-2015 2/2 that during internal enquiry, no shortage was found in the godown in question.

Mr. Shailendra Kumar Singh, learned counsel for the BSFC does not controvert the aforementioned contention of learned counsel for the petitioner and submits that on suspicion the accusation was levelled.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Pachrukhi P.S. Case No. 307 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
