Petitioner seeks bail in connection with Barauli P.S. Case No. 184 of 2016 registered under Sections- 363, 366/34 of the Indian Penal Code.

It is alleged that the daughter of informant had gone out to attend the call of nature, however she did not return. Search was made. It was learnt that petitioner and other family members have kidnapped her daughter with intention to kill her or sell her.

Learned counsel for the petitioner submits that the victim in her statement under section 164 Cr.P.C. has stated that petitioner did not do anything wrong with her. It is further

Patna High Court Cr.Misc. No.49502 of 2016 (3) dt.18-01-2017 2/2 submitted that medical report shows the age of the victim to be 17-18 years. This is a matter of love affair between the victim and petitioner. Petitioner is in custody since 06.09.2016. Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Barauli P.S. Case No. 184 of 2016.
