29-09-2016 Heard Sri Anil Kumar, learned counsel, who was assisted by Sri Rajeev Ranjan, learned counsel for the petitioner and learned Addl. Public Prosecutor.
The sole petitioner, who has been made accused with specific accusation of committing rape in Jehanabad (Mahila) P.S. Case No. 25 of 2016, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner is handicap to the extent of 50% and as such, there was no possibility of committing rape by him. By way of referring to Annexure - 3 to the petition i.e. medical report of the victim, learned counsel for the petitioner submits that during medical examination, no sign of rape was found on the person of the informant, whereas, on perusal of the F.I.R., it appears that victim
Patna High Court Cr.Misc. No.40863 of 2016 (2) dt.29-09-2016 2/2 lady was married and she was medically examined on 2nd June, 2016, whereas, alleged rape was committed on 30-05-2016. In view of specific accusation against the petitioner in the F.I.R. for committing rape, there is no reason to grant bail. Dismissed.
