ANJANA MISHRA ORAL ORDER 21-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Barauni P.S. Case No.223 of 2012 for allegedly having committed the offence under Sections 420, 364 and 365/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner along with Babloo Singh had taken away the husband of the complainant/informant for engaging him as a Labourer but after some time, the complainant's husband could not be traced. It is suspected that this petitioner along with said Babloo Singh caused disappearance of the husband of the complainant/informant. Learned counsel, however, submits that

Patna High Court Cr.Misc. No.33031 of 2015 (2) dt.21-08-2015 2/2 the petitioner and Babloo Singh had, in fact, taken the informant's husband for work but subsequently he left them. It is not known as to what happened thereafter. Learned counsel for the petitioner submits that similarly situated co-accused has been extended the privilege of regular bail in Cr.Misc. No.52185 of 2013, vide order dated 14.2.2014.

Considering the peculiar facts and circumstances of the case and that the petitioner has not taken away the husband of the complainant, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate/court concerned, Begusarai, in connection with Barauni P.S. Case No.223 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
