2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 323, 324, 325, 341, 307, 354, 504/34 of the Indian Penal Code.

3. As per allegation in the FIR, while the informant was sleeping in his asbestos house, there was brick batting on his house by the accused persons including the petitioner. It is further alleged that accused Ramayan Rai assaulted the informant by iron rod. Petitioner has assaulted the informant and his family members by leg and fist.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. General and omnibus allegation has been levelled against het petitioner.

Patna High Court CR. MISC. No.56195 of 2023(2) dt.05-09-2023 2/2 Injury received by Sanoj and Manoj are simple in nature. There is no allegation of repeated blow. Petitioner has got no criminal antecedent and languishing in judicial custody since 22.5.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM XIII, Saran at Chapra in connection with Dariyapur P.S. Case No. 138 of 2023.
