JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-09-2024 Heard Mr. Shanti Bhushan Singh, learned counsel appearing on behalf of the petitioner and Mr. Umeshanand Pandit, learned APP appearing on behalf of the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 332, 333, 353, 307, 504 and 506 of the Indian Penal Code.
3. As per prosecution case, all the accused persons named in the F.I.R., including this petitioner and 10 to 15 unknown persons attacked the police party with lathi, danda and iron rod, as a result of which several police personnel sustained injuries.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.58282 of 2024(2) dt.19-09-2024 2/2 behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case. There are general and omnibus allegations. There is no specific accusation of overt act against this petitioner. Petitioner claims clean antecedents.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he, along with other accused persons, assaulted the police party as a result of which several police personnel sustained injuries.
6. Considering the aforesaid facts and circumstances and nature of accusation, the prayer for grant of anticipatory bail to the petitioner is rejected.
