One stolen motorcycle is said to have been recovered from conscious possession of the petitioner but submission on behalf of the petitioenr is that at the time of his arrest petitioner disclosed in his confessional statement that it was one Sujeet Kumar Thakur, who had stolen seized motorcycle and had given to the petitioner, and both were using the said motorcycle. Petitioner does not have any criminal antecedent and is languishing in jail custody since 14.07.2016.
