The petitioner seeks bail in Civil Line P.S. Case No. 195/2018, instituted under Sections 379 and 411 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. There is no recovery of aforesaid vehicle from his possession. It is alleged in the written report that the informant as Project Incharge of Consultech Company along with other staff of the company were staying in Hotel Surya, Gaya for company work. The Company had provided him two Bolero vehicles. It is alleged that on the date of occurrence, the informant did not find both the vehicles in parking place. On enquiry, guard of the

Patna High Court Cr.Misc. No.68965 of 2018(2) dt.03-12-2018 2/2 hotel refused to say about it. The informant claimed that both the vehicles have been stolen by some unknown persons. Learned counsel for the petitioner has submitted that petitioner was arrested by the police and his confessional statement was recorded.

Learned counsel for the petitioner has filed supplementary affidavit enclosing therewith xerox copy of the seizure-list, which shows that the vehicle was recovered from a lonely place situated between Sono and Chakai in the district of Jamui. There is no signature of petitioner on the seizure-list. Petitioner is in custody since 07.06.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Civil Line P.S. Case No. 195/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
