JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2018 Petitioner prays for bail in connection with Naubatpur P.S. Case No. 225 of 2017, corresponding to Sessions Trial No. 443 of 2018, registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
Petitioner is said to be father of deceased and informant is the cousin brother of the deceased. Allegation against the petitioner is of causing death of the deceased in collusion with the wife of deceased and it is said that there was illicit relationship between them.
Submission of learned counsel for the petitioner is that there is no eye-witness to the occurrence and no injury was found on the person of deceased and viscera was preserved and petitioner is in custody since 3.8.2017.
