2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 504, 506, 34 of the Indian Penal Code and Section 27 of Arms Act.
3. As per prosecution case, allegation against the petitioner is to assault the son of the informant by means of garasa due to which he sustained injury. Co-accused Pinkesh is also said to have fired upon the injured.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The specific allegation of is against Pinkesh Kumar who fired upon the son of the informant Gunjan due to which he sustained
Patna High Court CR. MISC. No.57711 of 2024(2) dt.08-08-2024 2/2 gunshot injury. This petitioner has falsely been implicated in this case. He has got no criminal antecedent as stated in para-3 of the bail petition. It is further submitted that the petitioner is languishing in judicial custody since 22.05.2024. Similarly situated co-accused Rikesh Kumar @ Rikesh Singh @ Rinkesh Singh has already been granted bail, vide order dated 26.04.2024, passed in Cr. Misc. No. 19089 of 2024 by this Court.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Teghra P.S. Case No. 191 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai.
