The petitioner has preferred this application for grant of regular bail in a case registered under sections 366A and 34 of the Indian Penal Code.

As per allegation in the F.I.R., it is stated by the informant that the three named accused persons including the petitioner herein have taken away his minor daughter for the purpose of marriage.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. It is submitted that the daughter of the informant returned and her statement was recorded under section 164 Cr.P.C. wherein she

Patna High Court CR. MISC. No.10070 of 2021(3) dt.02-08-2021 2/2 categorically stated that she telephoned and forced Rahul Singh to come. Thereafter she married him and on learning about the arrest of this petitioner, she returned. The petitioner is in custody since 10.9.2020 and has no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the contents of the statement of the daughter of informant under section 164 Cr.P.C. together with the petitioner having remained in custody for over 10 months, the Court directs the petitioner to be enlarged on bail in connection with Sanjholi P.S. Case No. 84 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas.
