This is an application for grant of regular bail for offences punishable under Sections 47 (A) of the New Excise Amendment Act, 2016.
It has been submitted on behalf of the petitioner that though it is alleged that fourteen litres of country made liquor has been recovered from a bicycle, nothing has been recovered from the conscious possession of the petitioner and he has been in custody since 21.08.2016. Learned counsel for the petitioner further submitted that other co-accused of this case, namely, Agahanu Rishideo, has already been granted bail by this Court. Heard learned A.P.P. also.
Having heard both sides. In view of the fact that the
Patna High Court Cr.Misc. No.55519 of 2016 (2) dt.23-12-2016 2/2 petitioner has remained in judicial custody for about four months and there is no compliance of Section 100 of Cr.P.C, in this case, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Udakishunganj, Madhepura in connection with Udakishunganj P.S. Case No. 122 of 2016.
