The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

No.62838 of 2021(3) dt.05-07-2022 2/3 The prosecution case as per F.I.R is that when the son of the informant objected from playing indecent songs through DJ, it is alleged that petitioners and coaccused Ritesh Kushwaha caught his son and co-accused Manu Kushwaha shot fire from his pistol which hit below the chest of the son of the informant. Co-accused Sanny Kushwaha fired in the air to create fear.

It is submitted by learned counsel for the petitioners that there is counter version of the occurrence also and petitioners' side also received injuries. There is general and omnibus allegation against the petitioners and the specific accusation of resorting fire upon the son of the informant is against co-accused Manu Kushwaha.

In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands)

Patna High Court CR. MISC. No.62838 of 2021(3) dt.05-07-2022 3/3 each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Bhojpur, Ara in connection with Jagdishpur P.S. Case No. 72 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
